Introduction

Welcome to Stylescope Icons, operated by Picano sp. z o.o. ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our web application and Figma plugin (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, please do not use our Service.

Services Overview

Our service offers a comprehensive SVG icons library accessible through our Service. We provide three distinct plans to cater to various user needs:
Free Plan: This plan grants access to a basic set of free icons without the need for registration.
Pro Plan: This subscription-based plan offers access to our complete icons library. Available in Quarterly and Annually tiers. Account creation is mandatory to access the Pro Plan.
Enterprise Plan: Designed for large organizations, the Enterprise Plan provides customized solutions and additional support. Please contact us directly to discuss specific requirements and obtain a tailored service package.

Usage Rights

Users are granted a non-exclusive, non-transferable license to use the icons for both personal and commercial projects. Users may share project files containing icons with their clients, provided the total number of icons transferred directly to any single client does not exceed 150. If you extend the number of transfered icons please contact us. Users must not share their account credentials or allow others to access their account.

Team Usage

Individual Licenses: Each team member must have their own individual license. A single user license cannot be shared among multiple users.
Reason for Multiple Licenses: Each user requires their own license to ensure proper usage tracking, adherence to licensing terms, and to maintain service integrity. Sharing a single license among multiple users undermines these goals and violates our terms of service.
Compliance: Companies must purchase the appropriate number of licenses for their team members to comply with our licensing requirements and ensure that all users have legitimate access to the icons.

User Account

Eligibility: To create an account and use our Service, you must be at least 18 years old. By registering for an account, you represent and warrant that you meet this age requirement.
Registration: To access the Pro Plan, you must create an account by providing an email address and verifying it through an OTP code. You are also required to provide your full name and may optionally provide your organization name.
Account Management: You can manage your account details, including changing your email, full name, and organization name, through the profile settings.

Payments and Billing

Our payment processing is managed by Lemon Squeezy, a third-party payment service provider. By subscribing to our service, you agree to comply with Lemon Squeezy's terms of service and privacy policy, in addition to our own terms. We are not responsible for any errors, omissions, or breaches of contract by Lemon Squeezy.
Refund Policy: All subscription fees are non-refundable except as required by law. If you cancel your subscription before the end of your current billing cycle, you will retain access to the service until the end of the billing period, but no refunds will be issued for the unused portion of the subscription. If you experience any issues with your subscription, please contact our support for assistance.
Payment Information: Users must provide accurate and up-to-date payment information. By subscribing to the Pro Plan, users authorize Lemon Squeezy to charge the provided payment method for the applicable subscription fees. Users are responsible for any applicable taxes.

Icon requests

Users with active subscriptions are eligible to request icons as part of their service benefits. Pro plan users are subject to a maximum limit of 8 icon requests per month. All requests are fulfilled on a first-come, first-served basis to ensure fairness. Priority requests are exclusively available for Enterprise plan users.

Service Updates and Changes

We continually strive to improve our Service by adding new features, enhancing performance, and addressing user feedback. Consequently, we may update, modify, or discontinue certain aspects of the Service at our discretion. These changes may include, but are not limited to, feature enhancements, bug fixes, security updates, and alterations to the user interface.
Notification of Changes: Where feasible, we will notify users of significant updates or changes to the Service via email or through in-app notifications.
Continued Use: Your continued use of the Service following any updates or changes constitutes your acceptance of those modifications.
Service Interruptions: While we strive to minimize disruptions, there may be temporary interruptions to the Service due to updates or maintenance. We will endeavor to provide advance notice for any scheduled maintenance.

Affiliate Program

We offer an affiliate program through Lemon Squeezy. By participating in our affiliate program, affiliates agree to promote our services and abide by the terms set by Lemon Squeezy. Affiliates will earn commissions based on the referrals they generate. Detailed terms and conditions for the affiliate program can be found on our affiliate program page.

Termination and Suspension

We reserve the right to suspend or terminate accounts and access to our services if we suspect any violation of these Terms or any fraudulent, abusive, or unlawful activity. Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service.

Data and Privacy

Data Collection: We collect usage data such as IP address, browser name, and activity. For account creation, we collect email address, full name, organization name (optionally) and limited payment data.
Data Protection: We implement appropriate technical and organizational measures to protect the personal data we collect. For more information, please review our Privacy Policy.

Intellectual Property Rights

All icons and related content, including features, and functionality provided through our Service are the intellectual property of Picano sp. z o.o. and its licensors. The following stipulations apply:
Ownership and Rights: The ownership of all icons and associated content remains with Picano sp. z o.o. and its licensors. Users do not gain any proprietary rights through their use of the Service.
Trademark Restrictions: Our trademarks and trade dress may not be used in conjunction with any product or service without prior written consent from Picano sp. z o.o.
Restrictions on Use: Users are strictly prohibited from selling, sublicensing, or redistributing the icons in their original form without explicit written permission.

User Contributions and Content License

Users may contribute content to our service, such as feedback or comments. By submitting content, users grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and distribute the content. Users warrant that they own the rights to their contributions and that their content does not infringe on any third-party rights.

Prohibited Activities

Users agree not to engage in activities such as:
Reverse engineering our software.
Using automated systems to access our services.
Using the service for competitive analysis or commercial gain outside the agreed terms.
Engaging in any unlawful, harmful, or abusive activities.

Limitation of Liability

To the maximum extent permitted by law, Picano sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use our services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our services.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.

Changes to the terms

We reserve the right to modify these Terms at any time. We will notify users of any changes by posting the new Terms on our website and updating the effective date. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
